Communities large and small have need of sound legal advice, whether they are planning for the future by making changes to the zoning ordinance or pursuing financing strategies for redevelopment.  During this tough economic season, cities and counties have a chance to study up on the legal foundations and consequences of planning actions and tools.

 

From the legal relationship between the zoning ordinance and comprehensive plan to the process of creating a tax allocation district, elected and appointed officials as well as planning and economic development staff can benefit from the experience of local attorneys who have specific knowledge of these tools and issues and how to navigate them successfully.

 

The objective of this course is to transmit an understanding of the basics of key legal concepts related to planning and redevelopment.  Participants will come away with a clearer understanding on planning and land use law.



AGENDA

Legal Foundations of Planning and Zoning

Speaker: Peter Olson, Jenkins Olson Bowen, PC

 

Session objective: This session will outline the legal aspects of planning and zoning in Georgia, specifically the Atlanta region. The emphasis is on how these legal and regulatory requirements affect the job of elected officials and planning staff.

 


Zoning and its Relationship to the Comprehensive Plan             

Speaker: Bob Zoeckler, Maddox Nix Bowman & Zoeckler

 

Session objective: The relationship between the zoning ordinance and comprehensive plan is an important one.  When cities or counties are faced with challenges to zoning actions, this relationship is especially important.  This session will focus on how communities can be sure all of their planning documents are in agreement and do not leave them without proper legal support.

 


Understanding and Financing Key Redevelopment Tools

Speaker: Sharon Gay, McKenna Long & Aldridge LLP

 

Session objective: From TADs and SPLOSTs to floating GO bonds, cities and counties are using increasingly complex tools to carry out redevelopment across the region.  Officials and staff leading the way must have a solid understanding of these concepts and how they will impact their communities in years to come.  This session will give participants the information they need to make informed decisions regarding their community’s future.

 


Mixed-Use Zoning: Boom or Bust?

Speaker: Kathy Zickert, Smith Gambrell & Russell

 

Session objective: Many communities throughout the region have recently put into place mixed-use zoning districts.  Are these districts successful in spurring development/redevelopment?  What things should a community consider before enacting mixed-use zoning?  This session will take a look at mixed-use zoning districts, how they are crafted and how and where it is best to employ them.
